Terms and Conditions
Resale Pricing: All Elyte Hydration products must be resold at the current Recommended Retail Price (RRP) unless agreed otherwise with Annelies Grimshaw.
- 30-Pack: $69.95
- 12-Pack: $34.95
Payment Terms: All wholesale orders must be paid in full prior to shipment, unless otherwise agreed in writing.
Consignment Stock: Where Elyte has expressly approved a customer to receive products on consignment, the following additional terms apply. Approval of a wholesale account does not constitute approval for consignment.
- All consignment stock remains the property of Elyte until sold. Risk in the stock passes to the customer on delivery.
- Consignment stock becomes payable at the agreed wholesale price when sold, lost, damaged, unable to be accounted for, or not returned when requested by Elyte.
- The customer must maintain accurate stock records and provide sales and stock information when reasonably requested. Elyte may reconcile consignment stock and require the return of unsold stock at any reasonable time.
- Elyte will invoice for stock sold or otherwise payable under these terms, with payment due under the customer’s agreed wholesale payment terms.
- The customer acknowledges that Elyte’s interest in consignment stock may constitute a security interest under the Personal Property Securities Act 1999 and authorises Elyte to register that interest on the Personal Property Securities Register where Elyte considers appropriate.
However, to protect brand integrity and ensure fair treatment of all retail partners, the following conditions apply:
- Retailers must not bid on Elyte-related keywords (including brand name, product names, or close variations) in Google Ads or other paid search platforms.
- It is company policy that retailers must not use any form of paid media to advertise or promote Elyte — including paid search, paid social ads, display advertising, boosted/sponsored posts, or paid influencer partnerships. Only organic (unpaid) content and EDM (email marketing to your own existing customer database) are permitted. This policy exists to protect brand integrity and ensure fair, consistent marketing conditions across all retail partners.
- Retailers must not implement SEO strategies specifically targeting Elyte brand terms (e.g. “Elyte electrolytes”, “Elyte hydration”) without approval.
- Elyte products must not be advertised as “on sale” or promoted with discount messaging beyond the permitted pricing rules.
All marketing activity relating to Elyte must be reviewed and approved prior to launch.
Note: Elyte’s marketing team is happy to support store launches through approved campaigns, pop-up activations, sampling, and other collaborative initiatives — please contact us to discuss options.
Shipping: Free shipping on all wholesale orders.
Exclusivity: Elyte products should only be sold at your physical store(s), your direct-to-consumer channels, or approved online store. Third-party marketplace listings (e.g. Amazon, eBay) are not permitted unless explicitly approved.
Returns and Damages: Returns are only accepted for damaged or defective goods reported within 7 days of delivery.
Product Integrity: Stockists must ensure Elyte Hydration products are displayed and stored appropriately to maintain quality and freshness.
Termination Clause: Elyte reserves the right to terminate supply if these terms are not adhered to.
Jurisdiction: These terms are governed by the laws of New Zealand and Australia.
Privacy Statement: All information provided will be kept confidential and used solely for wholesale account purposes.
By submitting this application and placing a wholesale order, you acknowledge that you have read, understood, and agreed to these Terms & Conditions. Elyte Ltd reserves the right to amend these terms at any time, with notice provided to wholesale partners.
